Kan. man jailed after he passed out in running vehicle at intersection

WABAUNSEE COUNTY —Law enforcement authorities are investigating a suspect on multiple allegations after an arrest.

Just after 4p.m. Wednesday, Cpl. Jon Sumner of the Wabaunsee County Sheriff’s Office was on active patrol when he encountered a suspicious vehicle parked directly within the middle of the Kansas and Kansas 99 intersection south of Alma, according to a media release.

 Sumner observed the driver slouched over the steering wheel and summoned EMS. Realizing the vehicle was running and still in drive  Sumner immediately returned to his patrol vehicle and gently set his push bar in direct contact with the suspect vehicle grill in a head to head to prevent it from rolling off road, into traffic or suddenly being able to flee or elude.

Sumner roused awake and made contact with the driver, identified as 25-year-old Dustin Marquarndt of Dwight, Kansas. Marquarndt was asked to step out of the vehicle after  Sumner noticed signs of impairment and the presence of a firearm.

Assisting the driver from the vehicle, Sumner observed illegal narcotics in plain view. The subsequent lawful probable cause search of the vehicle resulted in the discovery of approximately 1 gram of Methamphetamine, 4 grams of Cocaine & other associated illicit narcotics paraphernalia.

Due to the totality of circumstances & objective reasonableness to include the driver exhibiting signs of impairment, Cpl Sumner placed Mr. Marquarndt under arrest without incident transported him to the county jail where he was booked in on requested charges of possession of opiates/narcotic or certain stimulant, possession of marijuana, possession of narcotics paraphernalia, possession of firearm while under the influence of alcohol or drugs, illegal parking on highway and not wearing his seat belt.

Upon driver refusal to voluntarily submit to chemical testing, Sumner applied for, was granted and then executed a lawful blood draw search warrant upon the accused.
